Defend Your Castle [Password]: A Guide to the Best Strategies and Tips

Self defense is an affirmative defense against criminal prosecution that can be raised as legal justification when a person is accused of using force against another or the property of another. Under Texas law, there are instances when nonlethal force may be used in defense of oneself, another, or property. There are narrower instances when a person may use deadly force to defend themselves, another, or even property. In this article, we will discuss self defense, defense of a third party, defense of property, stand your ground, and the Castle Doctrine in Texas.

Good information, Thank you! I would suggest taking it to the next level...what to expect if you do defend yourself and wound or kill in self defense. I, and I'm sure others, have heard horror stories of jail pending a trial in a self defense case, wounded intruders suing the homeowner for injuries incurred, confiscation of weapons, etc., but I've always wondered if they were true. What does, or can, really happen? Thanks again!

Hi Mark, I'm glad you found the information helpful! With regards to what to expect should you ever actually need to defend yourself, I too have heard the horror stories, and the info might make for a good follow-up article! In the meantime, it might be helpful to check out some of our articles on CCW insurance, as most of the companies provide legal services for this very situation, and they may have attorneys who would be able to give you additional information on what you might expect after a shooting.

Ultimately this statement is one about personal sovereignty over your property: that you should be able to control what happens with your property, should be able to control who is allowed to enter it, and should be allowed to defend it from intrusion.

If your home is your physical castle, your phone is your digital castle. More than any other computer, your phone has become the most personal of personal computers and holds the most sensitive digital property a person has, including:

So to extend the metaphor, if your phone is your digital castle, it means you should be able to control what happens with it, who is allowed to enter it, and should be allowed to defend it from intrusion.

Unfortunately, a great deal of software is designed and written in a way thatleads to total compromise when a firewall is breached. This is not good enoughtoday. Just because some defensive mechanism has been compromised doesn't giveyou the right to concede defeat. This is the essence of defense in depth: atsome stage you have to defend yourself. Don't rely on other systems to protectyou. Put up a fight because software fails, hardware fails, and people fail.People build software, people are flawed, and therefore software is flawed. Youmust assume that errors will occur that will lead to security vulnerabilities. That means the single layer of defense in front of you will probably becompromised, so what are your plans if it is defeated? Defense in depth helpsreduce the likelihood of a single point of failure in the system.

Let's quickly revisit the castle example from the first chapter. This time, your users are the noble family of a castle in the 1500s, and you are thecaptain of the army. The bad guys are coming, and you run to the lord of thecastle to inform him of the encroaching army and of your faith in your archers, the castle walls, and the castle's moat. The lord is pleased. Two hours lateryou ask for an audience with the lord and inform him that the marauders havebroken the defenses and are inside the outer wall. He asks how you plan tofurther defend the castle. You answer that you plan to surrender because the badguys are inside the castle walls. A response like yours doesn't get you far inthe armed forces. You don't give up--you keep fighting until all is lost oryou're told to stop fighting.

Test your skills and learn new strategies to defend against attacks. Choose from defensive options that mirror real-world cybersecurity strategies in Defend the Crown and see how well they perform against a crowd of ninjas trying to raid your castle.

Canadians have a right to defend their property or themselves as long as their defensive actions are reasonable under the circumstances. This means that if you injure an intruder entering your home or property, you would need to show that the circumstances gave you no other reasonable choice. Essentially, you can use whatever force is needed to prevent someone from unlawfully entering your house or from hurting you, but not more. The use of lethal force would generally only be appropriate in a situation where you had cause to perceive a threat to your life or of severe bodily harm, and had no other reasonable options for defending yourself.

The Criminal Code, section 34, deals with our right to lawfully defend ourselves (or our loved ones). Under the law, we can defend ourselves with reasonable force if we are physically attacked or if we have good reason to believe that a person is going to use force against us or against another person, such as a family member. However, our actions must be solely for the purpose of defending or protecting ourselves from harm. For example, if we continue to strike someone who is no longer a threat, then that action would not be perceived as lawful. As in the defence of property, a person can legally defend themselves by actions that are reasonable in the circumstances. Some of the factors that the courts will use to judge if you used reasonable force in defending yourself are:

Under section 34 and 35 of the Criminal Code, you are within your rights to defend yourself and your home from unlawful entry, but each case is assessed on the unique facts of the case. If you face assault or firearms charges arising from an incident involving self-defence or defence of your property, the key to your defence is convincing the Crown or court that your actions were reasonable given all the circumstances surrounding the event. Call the experienced criminal lawyers at Kruse Law if you were detained or arrested on any assault charges to find out about your legal rights and get us working on a strong defence today.

Simultaneously, military engineers recognised the weakness of the Spur as being vulnerable to bombardment by cannon from higher ground to the north-east. The barbican was remodelled as an infantry strongpoint, while the outer wall of the castle on the north-east side was reduced in height and backed by an earth earthwork to help absorb incoming cannon shot. Two new positions for defending cannon were built, at Bell Battery and Four Gun Battery.

In 1939, Dover resumed its former role when war came again, with the castle as headquarters, but for the Army garrison defending the town, and for the re-established Royal Navy base. The empty underground casemates were re-commissioned as bomb-proof offices for the vice-admiral in charge of the naval base, and as headquarters for army units co-ordinating coast artillery and anti-aircraft defences and for the units defending the Dover fortress.
